Résumé
Jember Regency has faced significant challenges with a high prevalence of stunting in East Java over the last three years. This study aims to examine the local government's efforts to reduce stunting rates and analyze the effectiveness of these measures through the lenses of Legal Effectiveness Theory and Maqashid Syariah (Hifdzu al-Ummah). This qualitative research employs a socio-legal approach (juridical-empirical), with data collected through interviews, observations, and documentation. The findings indicate that the government’s initiatives include: tightening administrative requirements for marriage dispensations, implementing the PMT-P program, conducting periodic nutritional monitoring (PEGAS), utilizing Mobile Obstetric Monitoring technology, and fostering cross-sector collaboration with academia, the private sector through CSR, and NGOs. Furthermore, food innovation was introduced through biofortified rice. From the perspective of Legal Effectiveness Theory, these programs have been effective across legal, institutional, facility, and cultural dimensions, although the tightening of marriage dispensations remains suboptimal as it is currently based only on a Circular Letter (Surat Edaran). In terms of Maqashid Syariah, these policies manifest the government’s responsibility to protect life (Hifdzu al-nafs), lineage (Hifdzu al-Nasl), and property (Hifdzu al-mal) for the public interest, serving as an implementation of Jember Regency's obligation toward Hifdzu al-Ummah.
